Please read these Terms of Use ("Terms") carefully before using the KOLHero: Crypto Influencer Sim mobile application ("KOLHero" or the "App") published by EDUAPPS MOBILE LIMITED ("we", "us", or "Company"). By downloading or using the App, you agree to be bound by these Terms.

1. Nature of the App — A Game, Virtual Only

KOLHero is a casual game for fun and learning in which you play a crypto influencer. Everything in the App is virtual, including followers, likes, comments, game money, coins, memecoins, tokens, NFTs, brand deals, sponsors, and gifts or donations from fans. The App:

• uses virtual game currency only and involves no real money, no real cryptocurrency and no other real assets;
• does not accept deposits,
• does not process withdrawals,
• does not hold user funds,
• does not execute real trades: charts and prices in the App are part of the game, and no real assets are ever bought or sold;
• does not offer payouts or real prizes; and
• is not a broker, exchange, financial institution, or investment adviser.

Nothing in the App or on our website constitutes financial, investment, trading, legal, or tax advice. Calls, takes and posts in the App, including yours and those of other players and characters, are game content and not recommendations to buy or sell anything. Simulated results in the App do not predict or guarantee any results in real markets, and you remain solely responsible for any decisions you make outside the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you should review these Terms with a parent or guardian. By using the App, you represent that you meet the minimum age requirement in your jurisdiction.

3. Simulated Market and Influencer Mechanics

The App shows pumps, rug pulls, paid promotions, scams and other risky or harmful practices of the crypto world as game mechanics, so that players learn to recognize them. They are fiction. Doing such things in real life can harm other people and may be illegal, for example as market manipulation, fraud or undisclosed paid promotion. You must not use the App, or anything you learn or create in it, to promote real cryptocurrencies, tokens, projects or investments.

4. Educational Content

The App includes short lessons and facts about crypto, such as wallets and seed phrases, scams, rug pulls and the history of the crypto market. This content is general, simplified for a game, and may not reflect current market conditions, regulatory changes, or individual circumstances.

5. Virtual Currency, In-Game Items and Ads

The App includes virtual currency and in-game items (e.g., game money, followers, items, looks, homes and rewards). These:

• are for gameplay only and have no cash value,
• are not legal tender, cryptocurrency, or any other real asset,
• cannot be withdrawn, cashed out, sold, transferred, or exchanged for money, cryptocurrency, or anything of value, whether from us or from anyone else,
• may be modified, reduced, or removed at any time, and
• may be forfeited if we suspend or terminate your access for violations.

The App shows ads. Some ads are optional: watching them gives in-game rewards only. Ratings, leagues, duels, debates and similar competitions in the App award virtual rewards only. There are no real prizes, cash rewards, or payouts of any kind.

6. Your Content and Community Rules

Where the App lets you publish content (such as your in-game name, calls, takes, posts or comments), you are responsible for it. You keep any rights you have in your content and grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and moderate it in the App and in connection with operating the App.

You must not publish content that:

• promotes real cryptocurrencies, tokens, projects, investment schemes or trading services, or contains links or contact details for them;
• is a scam, phishing or any attempt to get money, wallet details or seed phrases from other players;
• contains personal information about you or anyone else;
• is hateful, harassing, threatening, or bullying;
• is sexual or violent;
• is illegal or encourages illegal activity; or
• impersonates another person, company, or our staff.

You can report content or players to us through the App where available, or through our support form. We may review content and reports, hide or remove any content, and restrict, suspend or terminate accounts that break these Terms or the law, with or without notice.

7. Fictional Characters and Real-World References

The characters in the App, including Nanny, other KOLs and brands, are fictional. Any resemblance to real persons, living or dead, or to real projects and companies is coincidental.

The App may mention real-world events, projects, cryptocurrencies, and companies. Such references are made only for educational and historical context. We are not affiliated with, sponsored by, or endorsed by any of them, and a mention is not an endorsement or recommendation of any project, asset, or company. All trademarks belong to their respective owners.

8. User Conduct

When using the App, you agree not to:

• use the App for any unlawful, fraudulent, or harmful purpose;
• attempt to bypass, disable, or interfere with security-related features;
• cheat, exploit bugs, manipulate ratings, or use bots/automation;
• reverse engineer, decompile, or attempt to derive source code (except where prohibited by law);
• copy, modify, distribute, sell, lease, or create derivative works from the App or Content;
• attempt to sell, trade, or exchange accounts, virtual currency, or in-game items for money or anything of value;
• use the App to provide investment services, solicit investments, or promote real cryptocurrencies or tokens.

9. Intellectual Property

"Content" means text, graphics, music, characters, UI, lessons, and other materials available through the App, other than content published by players. All Content is owned by or licensed to EDUAPPS MOBILE LIMITED and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial entertainment purposes only.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDUAPPS MOBILE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

12. Privacy

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via the App or this website. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in accordance with applicable law in the jurisdiction where EDUAPPS MOBILE LIMITED operates.

15. General Provisions

• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any right or provision will not be considered a waiver of those rights.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, sale of assets, or by operation of law.
• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App and supersede any prior agreements on this subject.
• Survival. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
